By accessing or using Exceptio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

1.1 Eligibility

The Service is intended for use by legal professionals. By using the Service, you represent that you are:

• At least 18 years of age
• Legally capable of entering into binding agreements
• A qualified legal professional or working under the supervision of a qualified legal professional

1.2 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate information and keep your account credentials secure. You are responsible for all activities that occur under your account.

Exceptio is an AI-powered legal research platform designed to assist criminal defense lawyers in analyzing case documents and legal materials.

2.1 AI-Powered Analysis

The Service uses artificial intelligence to analyze documents and provide research insights. AI analysis may contain errors, inaccuracies, or incomplete information. You acknowledge that:

• AI outputs require professional review and verification
• The Service may not identify all relevant legal issues or precedents
• You remain solely responsible for all legal decisions and advice

2.2 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

3.1 Document Accuracy

You are responsible for ensuring that all documents you upload are accurate and complete. The quality of AI analysis depends on the quality of input documents.

3.2 Appropriate Use

You agree not to use the Service to:

• Upload or process illegal content
• Violate any applicable laws or regulations
• Infringe on the rights of third parties
• Attempt to circumvent security measures or access restrictions
• Use automated systems to access the Service without authorization

3.3 Confidentiality

You are responsible for ensuring you have the necessary rights and permissions to upload documents to the Service. This includes obtaining any required client consent for processing case materials through AI systems.

3.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access or security breach.

The Service operates on a credit-based system. Credits are used to access various features and AI processing capabilities.

4.1 Credit Purchases

Credits can be purchased through the Service using various payment methods including credit cards and iDEAL. All prices are displayed in Euros and include applicable taxes.

4.2 Subscription Plans

Subscription plans provide monthly credit allocations at discounted rates. Subscription credits are included in your balance and follow the same non-expiration policy.

4.3 Payment Processing

Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store complete payment card information on our servers.

5.1 Your Content

You retain all ownership rights to documents and content you upload to the Service. By uploading content, you grant us a limited license to process that content solely for the purpose of providing the Service to you.

5.2 Our Platform

Exceptio, including its software, user interface, design, logos, and all related intellectual property, remains the exclusive property of Exceptio. Nothing in these Terms grants you any rights to our intellectual property except as explicitly stated.

5.3 AI Outputs

Analysis results and other outputs generated by the Service based on your content are provided for your use in connection with the Service. We do not claim ownership of outputs derived from your content.

6.1 No Legal Advice

THE SERVICE DOES NOT PROVIDE LEGAL ADVICE. All information, analysis, and outputs provided by the Service are for informational and research purposes only. You must independently verify all information and consult with qualified legal professionals before making legal decisions.

6.2 No Guarantee of Accuracy

AI analysis may contain errors, omissions, or inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any outputs. The Service may not identify all relevant issues, precedents, or arguments.

6.3 Use at Own Risk

You use the Service at your own risk. We are not responsible for any decisions made or actions taken based on information provided by the Service.

6.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCEPTIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

6.5 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the Service. Upon termination:

• Your access to the Service will be revoked
• You may request deletion of your data as described in our Privacy Policy
• Unused credits are non-refundable

7.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Use the Service in a manner that threatens the security or integrity of the platform

7.3 Effect of Termination

Termination does not affect any rights or obligations that accrued prior to termination. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) shall survive.

8.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

8.2 Jurisdiction

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

8.3 Data Protection Compliance

We may update these Terms from time to time. When we make material changes:
